The terms on which you may use this website and the free tools on it. Anything you buy is governed by the purchase and engagement terms instead.

01These terms, and your agreement to them

These terms govern your use of this website and the free tools on it. They form a binding agreement between you and Lumineer, the professional practice of Aneta Kosinska (“the practice”, “we”, “us”). By using the site you accept them. If you do not accept them, please stop using the site.

Three related documents sit alongside these terms and form part of them:

  • The privacy policy, for what happens to your information.
  • The disclaimer, for what this work is and is not, and for results.
  • The purchase and engagement terms, which govern anything you buy. Where those terms and these ones conflict about a purchase, those terms win.

These terms may be updated. The date at the top shows when they last changed in substance, and continuing to use the site after a change means accepting the current version. A change is never applied retroactively to a purchase already made.

02Who may use this site

You must be at least 16 years old, and old enough in your own jurisdiction to enter a binding contract, to use this site. It is a business-to-business practice and nothing on it is directed at children.

If you are using the site for an organisation, you confirm you have authority to accept these terms on its behalf, and “you” means both you and that organisation.

You are responsible for complying with the law where you are. The site is operated from Canada and is not directed at any jurisdiction where doing so would be unlawful.

03What you may do with the site

You are granted a personal, revocable, non-exclusive, non-transferable licence to access the site and to read, print or save pages for your own business or personal reference.

You may quote short extracts with attribution to Lumineer and a link back to the page. Sharing your Momentum Score result link with colleagues or on social media is expressly permitted — it is designed for that.

Without written permission you may not:

  • Republish, resell, sublicense or systematically copy substantial parts of the site.
  • Reproduce the diagnostic method, the six-dimension instrument, the question set or the scoring approach in a product, tool or training of your own.
  • Use the content to train, fine-tune or ground a machine learning model, or scrape it in bulk for that purpose.
  • Remove or obscure any notice of authorship or ownership.
  • Frame or mirror the site, or present it as your own or as endorsing you.

04Intellectual property

The site and everything in it — text, structure, design, code, diagrams, photographs, the e-book, the Business Momentum Sprint method, the Business Momentum Score instrument, and the names Lumineer, Business Momentum Sprint, Business Momentum Score and LUMI — are owned by the practice or used under licence, and are protected by copyright and other intellectual property law in Canada and internationally.

No right in any of it transfers to you by using the site. Rights not expressly granted are reserved.

Third-party names, logos and trade marks shown on the site — including client and former employer marks — belong to their owners. They are used to identify real past work. Their presence is not a claim of endorsement, partnership or current engagement.

If you believe something on this site infringes your rights, write to aneta@lumineer.partners with enough detail to identify the material and your claim. Genuine complaints are acted on promptly.

05What you send us

When you use a form, take the assessment, or email the practice, you keep ownership of what you send. You grant only the permission needed to receive it, reply to it, and do the work you are asking about.

You also confirm that what you send:

  • is yours to send, or that you have permission to send it;
  • does not breach anyone’s confidence, contract or intellectual property; and
  • is not unlawful, defamatory or malicious.

If you volunteer a suggestion or feedback about the site or the method, it may be used freely and without obligation or payment. Nothing stops you keeping an idea to yourself.

06Acceptable use

You agree not to:

  • Break, probe or circumvent the security of the site, its forms or its rate limits.
  • Submit forms automatically, or send volume traffic designed to degrade the service.
  • Impersonate anyone, or submit a false name or email address.
  • Upload or transmit anything malicious, or attempt to inject code through a form field.
  • Harvest email addresses or personal information from the site.
  • Use the site to send unsolicited commercial messages to the practice or anyone named on it.
  • Use it for anything unlawful, or to facilitate anything unlawful.

Access may be restricted or withdrawn where any of this happens, without notice, and serious matters may be reported to the relevant authority.

07The free tools

The Business Momentum Score is provided free and without any charge or obligation. It is a structured self-assessment: a considered instrument, but a self-report, and not a validated psychometric test, an audit, or a professional opinion on your business.

It is offered as it stands and as available. It may be changed, rescored, or withdrawn at any time. Because results are held in the page address rather than in an account, a link may stop resolving if the instrument changes — so save a copy of anything you want to keep.

What you do with the result is your decision and your responsibility. See the disclaimer.

08No advice, and no relationship, until one is agreed

The site is published for general information. It is not consulting, legal, accounting, tax, financial, medical or psychological advice, and it is not tailored to your situation.

Reading the site, using a tool, downloading the e-book or sending an enquiry does not create a consulting, advisory, fiduciary or confidential relationship. That begins only when a written engagement is agreed. The disclaimer sets this out in full and is incorporated into these terms.

09Availability, and changes to the site

Reasonable efforts are made to keep the site available, but it is provided without any promise of uninterrupted access. It depends on hosting, networks and third-party services that are not under the practice’s control.

Any part of the site may be changed, suspended or withdrawn at any time, and pages may be removed. Where a page recording something you bought is withdrawn, that does not affect what you bought.

Maintenance, an outage at a supplier, or an event outside reasonable control may interrupt the site without notice, and no liability is accepted for that interruption.

10Links and embedded services

The site links to and embeds services run by others: a Cal.com booking calendar, a Stripe checkout, social profiles, and research sources.

When you use one of those, you are dealing with that provider under their terms and their privacy policy as well as these terms. They are not controlled by the practice, and no responsibility is accepted for their content, availability, security or conduct. A link is not an endorsement.

11Disclaimer of warranties

No warranty is given that the content is complete, current or free of error, that the site is free of harmful components, or that any result described on it can be achieved by you.

Some jurisdictions do not allow the exclusion of implied warranties. Where that is so, the exclusions above apply only to the extent permitted, and nothing here affects a consumer guarantee that cannot lawfully be excluded.

12Limitation of liability

To the fullest extent the law allows, the practice is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, nor for loss of profit, revenue, business, goodwill, opportunity, anticipated saving or data, however caused and on any theory of liability, even if the possibility was made known.

This limitation applies to the practice, and to Aneta Kosinska personally in respect of acts done for the practice.

Nothing in these terms excludes or limits liability for: fraud or fraudulent misrepresentation; death or personal injury caused by negligence; anything else that cannot lawfully be excluded; or any right a consumer has under applicable consumer protection law, including Ontario’s consumer protection legislation.

13Indemnity

You agree to indemnify the practice against any claim, loss, liability and reasonable legal cost arising from your breach of these terms, your misuse of the site, or anything you submit that you had no right to submit.

This does not apply where the claim arises from the practice’s own breach, negligence or wrongful act, and the practice will notify you promptly of any claim and not settle it without your consent.

14What this work is

Lumineer, the professional practice of Aneta Kosinska provides business consulting and change readiness services to founders, owners and executives. The Business Momentum Sprint is a structured diagnostic and planning engagement about a business and the person leading it.

The method deliberately works at three layers: the operational, the mental and the somatic. That third layer is what distinguishes the work and it is also the reason this page exists, because working with how a decision feels in the body is easy to mistake for something it is not.

15What this work is not

In Ontario this distinction is a matter of statute, not modesty. Under the Regulated Health Professions Act, 1991, the practice of psychotherapy is a controlled act that may be performed only by members of specified colleges, and titles including “psychologist”, “psychotherapist” and “doctor” are protected in a health context. Nothing offered here is the controlled act of psychotherapy, and no protected title is claimed.

Accordingly, this work does not involve and must not be understood as:

  • Diagnosing, assessing or treating any physical or mental condition.
  • Treating trauma, or providing trauma therapy of any kind.
  • Prescribing, adjusting or advising on medication.
  • Crisis intervention or emergency mental health support.
  • Legal advice, accounting advice, tax advice, audit, investment advice, insurance advice or regulated financial planning.
  • Human resources or employment law advice about a specific employee matter.

If you are dealing with a health matter, see a qualified health professional. Doing this work alongside proper care is fine and often useful. Doing it instead of proper care is not what it is for, and no part of this website should be read as encouraging that.

Nothing on this website is monitored for emergencies. Email and enquiry forms are read during working hours and are not a route to urgent help.

If you are in immediate danger, or worried about your own safety or someone else’s, contact emergency services on 911 in Canada and the United States, or your local emergency number.

17Breathing, movement and somatic exercises

Some of the work, and some practices in the e-book, involve attention to breath, posture, movement, rest and physical sensation. They are offered as ordinary self-management practices, not as treatment.

Breathing and movement practices are not appropriate for everyone. Consult a doctor before starting any of them if you are pregnant, or if you have or may have a cardiovascular condition, high or low blood pressure, a respiratory condition, epilepsy or a seizure disorder, a history of fainting, glaucoma or retinal detachment, a recent injury or surgery, or a psychiatric condition including a history of psychosis or dissociation.

You take part voluntarily and you remain in charge of your own body. Stop immediately if anything hurts, if you feel faint, or if you feel distressed, and seek medical advice. Never do a breathing practice in water, while driving, or anywhere a loss of consciousness would be dangerous.

18Results are not guaranteed

What the work produces depends overwhelmingly on facts outside anyone ’s control: your market, your capital, your team, your timing, your health, the economy, and above all what you actually do in the weeks after the room empties. A diagnosis is not an outcome. Acting on it is, and that part is yours.

You remain solely responsible for your own decisions and for the results of them. Advice, options and recommendations are exactly that. Nothing discussed removes your obligation to exercise your own judgement, take your own professional advice where it is needed, and comply with the law that applies to your business.

19Testimonials, case studies and figures

This website publishes named testimonials and numbers from real engagements, used with permission. Being straight about what they mean:

  • They are the individual experience of that person. They are not an average, not a typical result, and not a prediction of what you would get.
  • Figures such as points of drag counted, deals closed, bonuses received or percentage improvements are as reported by that client about their own situation. They have not been independently audited.
  • Where a Momentum Score movement is shown, it is a movement on this practice’s own instrument, which is a structured judgement and not a validated psychometric test.
  • Charts illustrating how momentum tends to build are illustrative. They describe the shape clients report, not a forecast, and any numbers on them are examples.
  • No testimonial has been given in exchange for payment or a discount. Any future arrangement of that kind will be disclosed beside the testimonial itself.

This matters legally as well as ethically. Canada’s Competition Act prohibits materially false or misleading representations and requires that performance claims rest on adequate and proper testing. Client-reported outcomes are presented as exactly that, and are not dressed up as tested averages.

20Website content, research and the e-book

The written material on this site and in the e-book is general information for a general audience. It is not tailored to your circumstances and cannot be, because it was written without knowing them.

The e-book cites published research, roughly forty-five studies. Those citations are provided so you can read the source and judge it. Citing a study is not a claim that its findings apply to you, that the science is settled, or that following a practice will reproduce the effect reported. Research is summarised in good faith and may be superseded.

Content is provided as it stands. It may become out of date, and while reasonable care is taken, no warranty is given that everything is complete, current or free of error.

21Links and third parties

This site links to other websites — a booking calendar, a checkout, social profiles, research sources. Those are not controlled by the practice. No responsibility is accepted for their content, availability, security or privacy practices, and a link is not an endorsement of everything on the far side of it.

22No relationship is created by reading this

Reading this website, downloading the e-book, taking the Momentum Score or sending an enquiry does not create a consulting, advisory, fiduciary or confidential relationship.

That relationship begins only when a written engagement is agreed and the fee arrangement is settled. Until then, please do not send anything you would be uncomfortable having sat in an ordinary business inbox. Confidentiality obligations inside a paid engagement are set out in the purchase and engagement terms and are considerably stronger.

23Limits on liability

The limitations and exclusions of liability that apply to this website and to everything bought through it are set out in the terms of use and the purchase and engagement terms. They apply to this page too and are incorporated into it.

Nothing in this disclaimer excludes liability that cannot lawfully be excluded, including liability for fraud, for fraudulent misrepresentation, for death or personal injury caused by negligence, or any statutory right a consumer has that cannot be contracted out of.

24Governing law and where disputes are heard

These terms are governed by the laws of Ontario, Canada and the federal laws of Canada that apply there, without regard to conflict of laws rules.

You and the practice submit to the exclusive jurisdiction of the courts of the Province of Ontario. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose law gives you the right to bring proceedings in your own courts or to the protection of your own mandatory consumer law, nothing above removes that right.

Before litigation

If something goes wrong, raise it in writing to aneta@lumineer.partners first and allow 30 days to resolve it. Most things are fixable by a conversation, and this step is a genuine attempt at that rather than a hurdle.

Any claim connected with the site or the free tools must be brought within one year of the event giving rise to it, or as soon after as the law requires if a shorter limitation period cannot be shortened by agreement. This clause does not shorten a limitation period that applies to a consumer where the law forbids it.

25General

Severability

If a provision is found unenforceable, it is read down as far as needed to make it enforceable, or severed if it cannot be. The rest stands.

No waiver

Not enforcing a term on one occasion does not waive it, and no waiver is effective unless it is in writing.

Assignment

You may not assign these terms without written consent. The practice may assign them as part of a reorganisation or sale, provided your rights are not reduced.

Entire agreement

These terms, together with the privacy policy, the cookie policy, the disclaimer and (for purchases) the purchase and engagement terms, are the whole agreement about the site. Nothing in this clause limits liability for fraudulent misrepresentation.

Force majeure

Neither party is liable for failure to perform caused by an event outside its reasonable control, including outages at a supplier, network failure, natural disaster, epidemic, industrial action, or act of government.

Language

These terms are drawn up in English, and the parties have expressly requested that this agreement and all related documents be in English. Les parties ont expressément exigé que la présente convention et tous les documents qui s’y rattachent soient rédigés en anglais.
